Enforcement Notice Relaxed 2012

From time to time things just don’t go right and our clients can find themselves facing enforcement action. Tamar (Selby) in purchasing Parkhead quarry also acquired the responsibility to ensure completion of the quarry. The approved restoration scheme was principally to agriculture and required significant re-profiling of the site. Tamar sought our advice how to respond to Cumbria County Council.

Our strategy was to go back to first principles and look at what the purpose of the restoration scheme was. A revised restoration scheme was prepared shifting the emphasis from agricultural restoration to one focussing on the creation of habitats to promote biodiversity. This significantly reduced the requirement for soil and re-profiling and will provide an additional ecological resource. This scheme allowed the enforcement notice to be amended and time periods for compliance to be relaxed.  Parkhead quarry is now in an aftercare period.
